Shipping and Handling

Prices
All prices displayed on our website are GST-exclusive, unless otherwise indicated. All displayed prices are subject to revision without notice, and unless payment in full has been received by Acromat at the time of delivery, Acromat reserves the right to invoice goods at the price which is current at the time of delivery.

Installation is not included in the prices displayed on the Acromat website. Acromat is pleased to quote on installation where required - please contact us if you require a quote.

Order Processing

Order Acceptance Policy
All orders placed with Acromat are subject to our acceptance. We reserve the right to decline (i.e. not accept) any order up to the point of the order being dispatched (regardless of whether an invoice for the order being issued). We will notify you of acceptance, rejection or other cancellation of your order by email, sent to the email address you specify at the time of placing your order. If you provide us with an invalid email address, your order will be rejected by us.

Even if otherwise accepted by us, and without affecting the section entitled "Payment Methods" below, we will not dispatch an order until we have received payment in full for the total value of the order. We also reserve the right to cancel an order we have accepted at any time, including if we do not receive payment in full within 30 days of the order being placed by you.

Any confirmations generated by our website or otherwise provided by us to you of successful order placement and/or receipt, and/or processing a payment for the order you submit does not constitute acceptance of the order by us. If we decline your order after a payment for an order you have placed has been received and/or processed we will contact you to notify you of our rejection of the order and refund the payment in full.

Backorders
Backorders are required if you wish to purchase a quantity of products which is greater than the number Acromat currently has available in stock.

When this occurs, Acromat will contact you to discuss available options (i.e. keep the order and wait for the item to arrive in stock or cancel the order (or part of it) and receive a full refund for the unshipped items). Please note there may be additional shipping costs if you request a partial shipment of your order (i.e. shipment of the existing stock held by Acromat, and subsequent shipment of the balance of your order when Acromat's stock is replenished).

Order Tracking

To track your order, please log into our website with your account and look at the "My Order History page of your account. You will be able to see the status of all your orders. We also use the My Order History page to display any additional information about your order. Please check the order progress regularly and contact us if there are any issues or concerns.

Order Cancellations

You may cancel any order you have placed with us at any time before ordered items are dispatched by us for delivery to you. All requests for order cancellations by you must be done in writing and sent by email to acromat@acromat.com.au and will not be effective unless and until we send you an email confirming the cancellation. If you successfully cancel an order, Acromat will refund to you any payment you have made. However, please note the following charges may be payable by you if you cancel an order, and will be deducted from the amount of any refund to be made by Acromat to you:

  • eWAY Handling Fees - an eWAY Handling Fee of 2.5% of the total value of your order will be charged by Acromat to cancel your eWay transaction effecting payment of the order, and is not refundable.
  • Restocking Fees - A restocking fee of between 20 to 25% of the price of the relevant item may be applied by Acromat in its sole and absolute discretion, depending on the item.

Payment Methods
We must receive cleared payment in full for the total value of the order (including any applicable delivery fees) before we will accept and start processing your order. The following methods of payment are accepted:
  • eWAY (Immediate clearance) - all purchases made directly via the Acromat website use the online payment gateway system operated by Web Active Corporation Pty Ltd ACN 086 209 403 trading as eWAY (eWAYSystem). If you do not agree to use of the eWAY System you are unable to purchase via our website.
  • Other payment methods by negotiation (Delayed clearance) — this payment method is only applicable if Acromat is providing a quote to you in respect of a particular item you wish to purchase from Acromat. In this case Acromat may in its discretion accept other forms of payment as negotiated with you directly through the quote process.

Fraud Prevention

Acromat uses the eWAY System for all purchases made directly via our web site, and transmits your provided payment information to the eWAY System for processing.

Acromat is not responsible for the operation of the eWAY System and separate terms and conditions apply to it. You should consider these prior to making any purchase through the Acromat website. If you do not agree with any of the terms and conditions which apply to the eWAY System, you must not submit an order with us via the website (and if you have submitted an order, you must immediately cancel it).

Data Security

Acromat uses the industry standard security protocol Secure Sockets Layer (SSL) to encrypt all sensitive information (like your credit card details) that passes between your computer and the Acromat website, and is transmitted by Acromat to the eWAY System for your payment to be processed. We employ the latest 128-bit encryption technology in all areas of the site which require you to provide your personal or account information. This means that the credit card information you send is encrypted by your computer, and then decrypted again on our side, preventing others from accessing your private information in transit. The same thing applies when we transmit your information to the eWAY System to enable processing of your payment. So, when using an SSL capable browser, shopping on the Acromat website is perfectly safe. Accordingly, when your provide credit card information on our website, it is passed directly to the eWAY System via an SSL secured payment gateway and is at no stage permanently stored on our website, in our database or on our server. This means there is minimal risk of your credit card information being stolen or misused, even in the highly unlikely event of someone gaining access to our system.

Shipping

Shipping and delivery charges apply to all orders placed via the Acromat website, and you are solely responsible for payment of these, as shipping and delivery charges form part of the total cost of your order. Our shipping cost is calculated on the weight, volume and delivery post code for every order placed through our website, and is indicated on the website. Shipping and dispatch times (if provided) on our website are indicative only, and in no event are binding on Acromat. To avoid delays and possible second delivery charges, we strongly recommend that you provide an attended business address (such as a work address), where someone you trust will be available to receive and sign for the order during normal business hours.

Product Delivery

Goods with no installation are delivered using contract couriers. It is the customers responsibility to accept the goods from the carrier and to supply help if required.
The customer must inform Acromat to arrange special delivery requirements when the goods are ordered. Additional charges may apply to special delivery arrangements.

Delivery Times

Given the range of destinations Acromat delivers to, normal delivery times for items are difficult to estimate, especially given the nature of shipping large packages internationally. Acromat does not take any responsibility for any delays in shipping. Where possible we may be able provide consignment details and courier tracking numbers to customers to enable them to track delivery of their item once dispatched by Acromat (please contact Acromat directly to request these details).

Title, Loss, Damage and Shortages

Title to any products ordered via the Acromat website will pass to once your payment has been cleared and received in full by Acromat.

Shipping Insurance - Risk in the goods will pass to you upon dispatch for delivery to your nominated delivery address. Items purchased directly via our web site do not include any form of insurance and we therefore strongly recommend that you insure your goods against transit damage. Any insurance costs must be met by you, and we may, in our sole and absolute discretion, arrange for appropriate insurance on your behalf, at your request, and charge you an additional fee for our services.

All consignments are inspected and counted prior to dispatch. Any shortages, damage or discrepancies at the time of delivery must be noted on the consignment note and notification must be given to the carrier and Acromat immediately and in any event within 24 hours of the delivery being received. Failure to comply with this requirement will negate any claim being made against the carrier or Acromat, and to the fullest extent legally possible the goods delivered to the customer will be deemed to be correct and without damage, in all respects (including amount), subject to the "Warranty" and "Warranty Claims" sections of this Policy set out below.

Additional Fees and Charges

If we incur extra delivery charges in addition to those covered by the price paid for your order as a result of your action or inaction, these may be passed on to you at our discretion. An example of such charges are second delivery charges by couriers as a result of you or someone who can receive the goods not being in attendance at your nominated delivery address when you have specified that the address is attended during normal business hours.

Product Specifications

Acromat's policy is one of continual product improvement. As alterations occur to National and International Specifications for products, or improvements in product design are engineered, we reserve the right to substitute and supply you with the altered or improved product without prior consultation.

Warranty

All products sold by Acromat via its website are covered by a warranty against defective and/or faulty materials and workmanship for a period of 12 months from the date of dispatch for delivery to customers. This warranty is provided by CMO Trading Pty Ltd ACN 097 114 791 trading as Acromat, of 25 Manchester Street, Mile End South SA 5031, contactable by phone at +61 8 8352 2288 or (free call) 1800 808 451, by fax sent to 8 8352 7053 or by email sent to acromat@acromat.com.au.

If you are located in Australia, and are a consumer as defined by the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law), please note that:
  • Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
  •       (N B: The term "major failure" has a specific definition, set out in the Australian Consumer Law.)
  • Goods presented for repair may be replaced by refurbished goods of the sametype rather than being repaired. Refurbished parts may be used to repair the goods.


Warranty Claims

If you wish to make a claim under the warranty provided by Acromat in respect of the products sold via its website (as set out in the section entitled "Warranty" above), then BEFORE returning any the relevant goods to us you must initiate a return / warranty claim with Acromat by contacting us by email at acromat@acromat.com.au.

We will then confirm receipt of your claim and issue you with a Return Authorisation Number (RA Number) and discuss with you the basis of your claim, including by providing you with instructions on returning the faulty item to us, or the other actions which you should undertake. We will also determine who is responsible for shipping and any other relevant costs and advise you accordingly. For the avoidance of doubt, we can in our discretion arrange for shipment of the goods back to us, at our cost or yours. However, unless we let you know otherwise, you are solely responsible for all costs associated with returning goods to us, and the return by us of any replacement or repaired goods to you.

The RA Number is valid for 7 days from the date of issue, and during this time the faulty goods must be received by Acromat (unless otherwise agreed). The RA Number will not be extended or re-issued. The RA Number MUST be clearly displayed on any package returning the goods. Any goods returned without a valid RA Number, or without a RA Number, will be not accepted and will be shipped back to you at your expense. Depending on the item we may require that it is returned with all original accessories. Acromat reserves the right to reject incomplete or not properly packaged items, and return them to you at your cost and expense.

If we instruct you to return items to us, then once your goods have been properly returned to us in accordance with our instructions, we will test them to determine whether your claim of a fault/defect is valid. If so, we will in our sole discretion repair the goods and return them to you, issue you with a full or partial refund or a replacement item, or undertake anything else we consider is reasonable in the circumstances. The costs of shipping or returning goods to you will be borne and accounted for in the manner we direct.

If your warranty claim is determined to be invalid, we will return the item to you, and you must pay to us the costs of shipment together with a $45 (GST exclusive) service fee and any other fees and charges we reasonably determine are payable in the circumstances. The service fee and other applicable amounts, including shipment costs, must be paid to Acromat before it will return the item to you. If payment is not received by Acromat within 30 calendar days of request, then Acromat in its sole discretion may sell the item to recover the service fee, and if so, will refund to you any remaining balance.

Statutory Rights Unaffected

No part of this Policy is intended to limit, affect or otherwise derogate from any rights, entitlements or remedies customers may have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law set out in Schedule 2 of that Act), equivalent State and/or Territory legislation, or any other equivalent or relevant laws which may be applicable.

Specifically, the benefits conferred by the section entitled "Warranty" above are in addition to all other non-excludable warranties, conditions, guarantees, rights and remedies in respect of the goods available for sale via our website that customers may have under the Australian Consumer Law and corresponding laws in each jurisdiction within which the warranty operates from time to time (Non-Excludable Terms).

However, apart from the warranty set out in the section entitled "Warranty" above, to the fullest extent permitted by law, Acromat excludes:
  • all conditions, warranties, guarantees and terms implied by statute, general law, international convention or custom, except any Non-Excludable Terms. In particular, Acromat does not exclude or limit the application of any provision of any applicable statute, legislation or other regulation (including the Competition and Consumer Act 2010 (Cth) and its Schedules and Regulations) where to do so would contravene that statute, legislation or regulation or cause any part of this Policy to be void, and nothing in this Policy is to be interpreted as doing so;
  • all liability to customers for direct, consequential or indirect loss or damages arising out of or in connection with this Policy, or the goods or services it supplies to customers, even if Acromat knew they were possible, or they were otherwise reasonably foreseeable, and including without limitation, loss of profits and damage suffered as a result of claims by any third person; and
  • all liability to customers in negligence for acts or omissions of Acromat, its employees, agents, contractors, related entities and other representatives arising out of or in connection with this Policy and the Acromat website.
To the extent permitted by law, Acromat's's liability for any Non-Excludable Term applicable under the Australian Consumer Law or equivalent laws is limited to (at Acromat's option):
  • in the case of goods - replacement of the goods or the supply of equivalent goods, repair of the goods, payment of the cost of replacing the goods or acquiring equivalent goods, or payment of the costs of having the goods repaired; and
  • in the case of services - the supply of the services again or payment of the cost of having the services supplied again.

Refund Policy

Please research the products you are interested in carefully before placing an order. We generally do not provide refunds or exchanges for incorrectly ordered goods or if you change your mind once you have received the goods (unless you cancel an order as permitted by the section of this Policy entitled "Order Cancellations", prior to you taking delivery), but may do so in our sole and absolute discretion. Once delivered, no goods will be accepted for return without our prior approval and in no circumstances will goods be accepted for return for credit after 30 days from the date of invoice without our prior approval (except if a warranty claim is validly made).

If we do agree to accept goods for return, the goods must be returned to us at your sole cost and expense, with freight prepaid, and clearly marked with the name and address of the sender.

We take no responsibility for incorrect choice of product or for any hardware/software compatibility issues which you may experience. You are solely responsible for researching the specifications of the product you are interested in purchasing from Acromat via its website, via the information available from the manufacturer and other appropriate resources (Acromat may, but is not obliged to, provide you with relevant information regarding its products) and confirming that the product you purchase is appropriate to meet your their requirements.

If at our sole discretion, we decide to accept the return of non-faulty goods and provide you with a refund, the Restocking Fee, and eWAY Handling Fee explained in the "Order Cancellation" section above, together with any other non-refundable costs incurred by us in processing the refund and accepting the returned item will be recoverable by us from you, and will be deducted from the amount of the refund to which you are entitled.

Dead-On-Arrival (DOA) Products

If your item is faulty or defective at the time of delivery to you, please initiate a warranty claim in the manner outlined above within 7 days of taking delivery. All claims received outside this period are considered to be warranty claims, and treated by Acromat as such. Once we have examined the item and confirmed that it was defective/faulty at the time of delivery to you, we will either replace or repair the item, or refund the full amount of the order to you, as requested by you.

Bundles

Any promotions that we may run from time to time, at our discretion, may be, or may contain items bundled together. In any such cases, the components of the bundles are to be treated as individual items at a discounted price when purchased together. The warranties provided by Acromat are on these separate items, not on the bundle itself. In the case of a warranty/return claim, only the faulty item(s) in the bundle may be returned and replaced/refunded (as per this return policy) and any other products in the bundle that are returned will be treated as a change of mind and return of non-faulty goods which may be accepted by Acromat in its sole discretion, and may result in restocking fees. Alternatively, the item may be assessed for faults and returned to you at your cost.

Conditions of Sale

Acromat's standard Conditions of Sale apply to all items purchased via the Acromat website. If you would like to view Acromat's standard Conditions of Sale, please email your request to acromat@acromat.com.au and a copy will be forwarded to you.

In the event of an inconsistency between the Conditions of Sale and any of the terms and conditions of this Policy, the Terms of Use which apply to Acromat's website, Acromat's Privacy Policy or any other relevant policy of Acromat which applies to the Acromat website, the other document will prevail over the Conditions of Sale to the extent necessary.

Alterations

The terms and conditions of this Policy are subject to change from time to time without prior notice to you, and any changes are effective from the date of posting. It is your responsibility to review the current terms and conditions of this Policy and all other relevant policies, procedures, terms and conditions of Acromat prior to placing orders on the website.
